Terms of Service

Wonky Go is a physics puzzle game for iPhone, iPad and Android, with this website at https://wonkygo.com (together, the “Game”). The Game is created and operated by Roman Pushkin (“we,” “us,” “our”). You can reach us at roman.pushkin@gmail.com.

These Terms of Service (“Terms”) are a simple agreement between you and us about how you may use the Game. They are written in plain language on purpose: this is an indie game, not a bank.

1. Acceptance of These Terms

By playing the Game or using this website, you agree to these Terms. If you do not agree with them, please do not use the Game.

2. The Game

The Game has no accounts, no subscriptions, no purchases inside the game, no ads and no third-party analytics or trackers. It plays offline. Your progress is saved only on your own device, as described in the Privacy Policy. The app stores you download the Game from (Apple’s App Store, Google Play) have their own terms, which also apply to you.

3. Acceptable Use

When using the Game and this website, you agree not to tamper with, disrupt or attempt to gain unauthorized access to the Game or the systems it runs on; not to use the contact form to spam, harass or mislead; and not to use the Game for anything illegal. If you find a bug, we would love it if you reported it to us.

4. Intellectual Property

The Game — including its source code, artwork, sounds, music, levels, name and design — belongs to us. Playing the Game gives you a personal, non-exclusive, non-transferable, revocable license to play it. It does not give you the right to copy, sell, redistribute or create derivative works from the Game or its assets without our written permission.

If you send us feedback, ideas or suggestions, you agree we may use them freely, without any obligation or compensation to you. (Thank you — feedback is how the Game gets better.)

5. Privacy

The Game collects no personal data; this website keeps only what you send through the contact form. The details are in our Privacy Policy, which is part of these Terms.

6. Disclaimer

The Game is provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. It is made by one person: we do not promise it will always be available, uninterrupted or bug-free, or that your saved progress will never be lost.

7. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data (including saved progress), arising out of or related to your use of the Game. Our total liability for any claim relating to the Game will not exceed the amount you paid us for it. Some jurisdictions do not allow certain limitations of warranties or liability, so parts of this section may not apply to you.

8. Changes to the Game and These Terms

We may update, change, suspend or discontinue the Game (or any part of it) at any time. We may also revise these Terms from time to time; when we do, we will update the effective date at the top of this page. If you keep playing after a change, that means you accept the revised Terms.

9. Governing Law and Miscellaneous

These Terms are governed by the laws of the United States and, where applicable, the laws of the state in which the operator resides, without regard to conflict-of-laws rules. If any part of these Terms turns out to be unenforceable, the rest remains in effect. These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Game. If we do not enforce a part of these Terms at some point, that is not a waiver of our right to do so later.
